A UAE job offer quotes one headline number and then splits it into two, and the split is worth more money than the headline. End-of-service gratuity, overtime and your unemployment insurance payout are all calculated on basic salary alone. Housing, transport and every other allowance are excluded. Two candidates on AED 20,000 a month can walk away from five years of service with AED 70,000 or AED 21,000 depending on nothing but how the offer was structured.

This guide is about that one line in the offer letter. It sets out what the Labour Law says basic wage and total wage actually mean, which entitlements attach to which, what a low basic ratio costs in real numbers, and the MOHRE rules that decide whether you can change any of it after you sign.

The Two Numbers on Every UAE Offer

Basic wage is the pay for the work itself, excluding all allowances. Total wage is the basic wage plus cash allowances and benefits in kind. The Labour Law defines both, and the definitions decide which of your entitlements are calculated on which number.

Federal Decree-Law No. 33 of 2021 on the Regulation of Labour Relations defines basic wage as “the wage specified in the employment contract, which is paid to the Worker in return for his work under the employment contract, on a monthly, weekly, daily, hourly or piece-meal basis, and does not include any other allowances or benefits in kind.”

The same article defines wage as “the basic wage, plus the cash allowances and benefits in kind that are decided for the Worker under the employment contract or this Decree by law.” That is the number people mean when they say total package or gross salary.

A typical UAE offer therefore reads something like this:

Which Entitlements Run on Which Number

Gratuity: Article 51

The UAE Government portal is explicit that end-of-service gratuity is calculated on the basis of the last wage the worker was entitled to, namely the basic salary, and will not include allowances such as housing, transportation, utilities or furniture.

Article 51 sets the accrual at 21 days of basic wage for each of the first five years of service and 30 days for each year beyond that, with the total capped at two years’ wage. You need one year of continuous service to qualify, days of unpaid absence are excluded, and the employer must settle within 14 days of termination. Unemployment insurance: the trap nobody flags

The ILOE scheme is keyed to basic salary at both ends. The government portal states that the premium is up to AED 5 a month where basic salary is below AED 16,000 and up to AED 10 where it is above, and the insured worker is eligible for 60 per cent of the subscription salary for up to three months, capped at AED 10,000 a month in the first category and AED 20,000 in the second.

Read that carefully. The payout is 60 percent of the subscription salary, which is the basic salary, not the package. On a AED 20,000 package with a AED 8,000 basic, the monthly payout is 60 percent of AED 8,000, or AED 4,800, even though the category A ceiling is AED 10,000. Where a high allowance share works in your favor

The split is not uniformly bad for employees. Article 29(6) states that the worker is entitled to the wage for the period of annual leave, meaning leave is paid at total wage. Article 43 calculates the notice period payment on the last wage received, again the total. If you are dismissed with pay in lieu of a 90-day notice period, that payment is on the full package. A weak basic hurts your exit gratuity but not your notice pay.

What a Low Basic Ratio Actually Costs

On a AED 20,000 monthly package over five years, gratuity ranges from about AED 70,000 at a 100 percent basic to about AED 21,000 at a 30 percent basic. The package is identical. The difference is AED 49,000.

The figures below convert a monthly basic to a daily rate by dividing by 30, which is the standard market convention. The law does not state a divisor, so treat these as illustrative arithmetic rather than a guaranteed settlement figure.

The same ratio drags on overtime. Article 19 pays overtime at the rate corresponding to normal hours calculated according to the basic wage, plus at least 25 percent, rising to at least 50 percent for hours worked between 10pm and 4am. On a 30 percent basic, every overtime hour is worth less than a third of what it would be on a full basic.

Is There a Minimum Basic Salary?

The federal Labour Law sets no minimum ratio between basic wage and total wage, and no minimum wage at all. The UAE Government portal confirms that there is no minimum salary stipulated in the UAE Labour Law, though it includes general provisions requiring wages to be sufficient to meet employees’ basic needs.

That absence is the whole reason the split matters. A mainland employer is free to set basic at 30 percent of the package, and doing so is lawful. Your only protection is negotiating the ratio before you sign.

One notable exception sits inside the Dubai International Financial Centre. The DIFC Employment Law applies its own regime in which basic wage must not fall below 50 percent of the annual wage, together with a bar on manipulating basic wage to reduce end-of-service contributions. This is a DIFC rule only and does not apply on the mainland or in most other free zones. It is widely reported by employment law firms rather than published on an accessible official page, so confirm it with the DIFC if you are negotiating a DIFC contract. The Offer Letter Becomes the Contract

The MOHRE employment contract must be based on the offer letter you signed, and once registered its clauses cannot be changed unless your rights are not undermined, both parties agree, and MOHRE approves. The offer letter is not a preliminary document. It is the thing you are actually agreeing to.

The government portal sets out the sequence: the employer signs the job offer electronically and sends it to the worker for review and approval, the signed job offer is attached to the initial work permit application, and on arrival both parties sign it, at which point it is officially registered with MOHRE as a legally binding employment contract. The contract must be submitted to MOHRE within 14 days of arrival, or from the date of the status change if you are already in the country.

Three further rules are worth knowing before you sign:

  • Language. The job offer must be provided in Arabic and English plus a third language the worker understands. Nine third-language options are available: Bengali, Chinese, Dari, Hindi, Malayalam, Nepalese, Sinhalese, Tamil and Urdu.
  • Signature. Workers in professional levels 1, 2 or 3 must sign. A fingerprint is accepted for levels 4 and 5.
  • False information. Providing false information to the ministry can result in fines of up to AED 20,000.

Contracts are fixed term and cannot exceed three years, though they may be extended or renewed as often as both parties wish. What actually happens if the numbers do not match

The failure mode people hit is a MOHRE contract that shows a different basic-to-allowance split from the offer letter they accepted, usually with basic reduced. Because the contract is what MOHRE registers, the registered figure is what governs your gratuity years later. Compare the two documents line by line before signing the contract at the typing centre, not afterwards, because amending a registered contract requires the employer’s agreement and MOHRE’s approval.

What to Check Before You Sign

  • The basic-to-total ratio. Ask for it explicitly if the offer only shows a package figure. This is the single most negotiable line and the one most candidates never raise.
  • Whether allowances are cash or in kind. Company-provided accommodation is a benefit in kind and forms part of total wage, but it disappears the day you leave, unlike a cash housing allowance.
  • Notice period. Article 43 requires between 30 and 90 days, and the period must be the same for both parties unless the difference favors the worker.
  • Probation. Maximum six months, not extendable, and it counts toward your service if you continue afterwards.

Is gratuity calculated on basic salary or total salary in the UAE?

Basic salary. What percentage of salary should be basic in the UAE?

Does the housing allowance count toward gratuity?

Is there a minimum wage in the UAE?

How much unemployment insurance will I actually receive?

Sixty percent of your subscription salary, which is your basic salary, for a maximum of three consecutive months. The AED 10,000 and AED 20,000 figures are ceilings, not entitlements. You must have subscribed for at least 12 continuous months, have lost the job for reasons other than resignation, and file the claim within 30 days of the employment ending.

What is the difference between a job offer and an employment contract in the UAE?

Sequence rather than substance. The employer sends a signed job offer, you approve it, and it is attached to the initial work permit application.
