How the Calculation Works
- Eligibility: you need at least one year of continuous service. Below one year, gratuity is zero (Article 51(2)).
- First five years: 21 days of basic pay for each year of service (Article 51(2)(a)).
- After five years: 30 days of basic pay for each additional year (Article 51(2)(b)).
- Part-years: once you pass one year, part-years count pro rata (Article 51(3)). Unpaid absence is not counted as service (Article 51(4)).
- Salary basis: your last basic wage only, without housing, transport or other allowances (Article 51(5)).
- Cap: total gratuity cannot exceed two years’ pay (Article 51(6)).
- Payment deadline: your employer must pay within 14 days of the contract ending (Article 53).
