What Goes Into a UAE Final Settlement
Each item is calculated on a different salary base, which is where most settlement disputes start:

“Basic salary” excludes allowances. “Remuneration” is basic salary plus the cash allowances and benefits in your contract (Article 1). Gratuity and leave use the first; salary and notice use the second.
Worked Example
An employee on a basic salary of AED 10,000 and a total salary of AED 15,000 resigns after exactly seven years, with 20 days of unused leave and 12 days of the final month unpaid. Daily rates use the ÷ 30 method.

If the same employee had left with 30 days of notice unserved, payment in lieu of notice of AED 500 × 30 = AED 15,000 would come off, giving AED 52,666.67. If the employer had ended the contract without giving 30 days’ notice, the AED 15,000 would be added instead, giving AED 82,666.67.
Notice Pay: Who Owes Whom
Notice must be between 30 and 90 days, and the contract stays in force during it, with full pay. The parties can agree to waive or shorten notice, but the worker keeps the rights tied to the agreed notice period. The party that does not respect the notice period pays the other “payment in lieu of notice”: the worker’s remuneration for the whole notice period or the part not served, at the last salary. It is due even if the other party suffered no harm (Article 43).
Deadline and What to Do If You Are Not Paid
Your employer must pay your remuneration and all other entitlements within 14 days of the contract ending (Article 53). Ask for a written settlement statement that itemizes each line above and compare it with this calculator. If an amount is missing or a deduction is unexplained, raise it with HR in writing, then file a complaint with MOHRE.

What is included in a final settlement in the UAE?
Your end-of-service gratuity, pay for unused annual leave, salary for days worked but not yet paid, payment in lieu of notice if the notice period was not given, and any other amounts in your contract such as overtime or commission. Your employer can deduct amounts you lawfully owe.
How long does an employer have to pay the final settlement?
14 days from the date the contract ends. Article 53 of Federal Decree-Law No. 33 of 2021 requires the employer to pay your remuneration and all other entitlements within that period.
Is the final settlement calculated on basic or total salary?
Both, depending on the item. Gratuity and unused leave are calculated on basic salary. Unpaid salary days and payment in lieu of notice are calculated on your full last salary, including fixed allowances.
What happens if I do not serve my notice period?
You owe your employer payment in lieu of notice equal to your full salary for the notice days you did not work (Article 43). In practice the employer deducts it from your final settlement. It does not reduce your gratuity entitlement itself.
Do I get gratuity if I resign?
Yes, once you have completed one year of continuous service. Under the current law, gratuity is the same whether you resign or are dismissed, except in the specific dismissal cases set out in the law.
Can my employer deduct a loan from my gratuity?
Article 51(7) allows the employer to deduct amounts due legally or under a court ruling, following the conditions in the implementing regulation. Unexplained or unlawful deductions can be challenged through MOHRE.
